General Terms of Use of CHB (Crypto Holding Broker)
1. Introduction
Bitcoin Academy Sàrl (hereinafter referred to as “CHB”), is a Limited Liability Company (SARL) governed by Swiss law, operating under the brand name Crypto Holding Broker (CHB), with its registered office in Geneva, Switzerland. By using our OTC (Over-the-Counter) trading platform, you agree to these General Terms of Use.
2. Acceptance of Terms
By accessing or using CHB’s services, you agree to be bound by these General Terms of Use. If you do not accept these terms, you must not use our services.
3. Eligibility and Verification
3.1 AML/KYC Requirements: To access our OTC services, users must comply with AML (Anti-Money Laundering) and KYC (Know Your Customer) requirements and be verified at the required level.
3.2 Minimum Transaction Amount: Clients must meet a minimum transaction amount equivalent to 100,000 CHF, although exceptions may be considered on a case-by-case basis.
4. Use of Service CHB exclusively offers OTC Spot orders for large quantities of digital assets, providing deep liquidity and personalized service.
5. Data Confidentiality and Security
5.1 Data Transfer: Your personal information, including Personal Data, may be transferred to and stored on computers located outside of your state, province, country, or other governmental jurisdiction where data protection laws may differ from those of your jurisdiction.
5.2 Data Security: CHB will take all reasonably necessary measures to ensure that your data is treated securely and in accordance with this Privacy Policy.
6. Data Disclosure Legal Requirements
CHB will only disclose your personal information to third parties in the following cases:
○ When required by law.
○ As part of the fight against money laundering and terrorist financing.
○ When using our external technical support, your information may be stored by this support.
7. Risks and Responsibilities
7.1 Price Volatility: Prices of digital assets can be extremely volatile and unpredictable. Price fluctuations can lead to significant gains or losses.
7.2 Legal Risks: Legal risks may vary depending on the jurisdiction.
7.3 Limited Liability: CHB does not guarantee the security of transactions in the event of hardware or software failures and cannot be held responsible for losses resulting from transactions not executed as expected or executed incorrectly.
7.4 Counterparty Risks: OTC transactions involve counterparty risk, which is the risk that the other party to the transaction will not fulfill its obligations. CHB cannot guarantee the solvency or performance of counterparties and cannot be held responsible in case of payment default or non-delivery by a counterparty.
8. Transaction Settlement
8.1 Settlement Timeframe: Transactions must be pre-funded before each transaction.
8.2 Settlement Options: Digital assets can be settled in your CHB wallet or sent to an external wallet of your choice. Settlement options also include bank transfers for fiat currencies available for trading on CHB.
9. Amendments to the Terms CHB reserves the right to modify these Terms of Use at any time. In case of changes, we commit to promptly inform you and update this page to reflect the changes.
10. Termination Termination Rights: CHB reserves the right to suspend or terminate your access to the services at any time, without notice, for any reason, including but not limited to, violations of these Terms.
11. Governing Law and Jurisdiction
These General Terms of Use and the use of the Service are governed by and interpreted in accordance with Swiss law. Any dispute arising out of or related to these Terms and the use of the Service will be resolved by the competent courts of Geneva, Switzerland.
